Nirav Modi, an accused fugitive diamond merchant, has remained the focus of one of the largest banking fraud schemes in India, and he is accused of completing an elaborate scheme to defraud the Punjab National Bank out of more than $2 billion using false letters of undertaking. Nirav Modi fled to India before the fraud came to light and has continued fighting extradition proceedings since that time.

Recently, a U.S. court denied a request from Nirav Modi to reopen parts of his extradition case. The purpose of the request was to reopen a determination that the U.S. court made in connection with the extradition of Mr. Modi to India. At present, Modi is being held at a London-based prison awaiting the outcome of his extradition process per British law. He is appealing against his extradition in two British appellate courts and has been previously successful in obtaining approval for numerous judicial findings that would allow him to remain in jail or at least postpone the extradition process. Currently, Brahmarsh Sharma (US District Judge) and the British courts have ruled that there is sufficient reason to allow Modi to be returned to India to stand trial, but he can continue to appeal the previous decisions. Unfortunately for Modi, as the court systems continue to deny him the relief requested, the likelihood of successful appeals diminishes considerably.

Due to his previous failures in every previous court case he’s brought against India to avoid being sent there, Nirav’s probability of extradition increases daily. After arriving in India he will be prosecuted at least for a large amount of charges relative to a multi-billion-dollar banking fraud scheme. There are still ways he might appeal or find other legal relief but as courts continue to rule against him, his avenues for great long-term relief are rapidly becoming fewer. The final goal of the government of India is to get Nirav to return to India and charge him and so many others with being a part of the high-profile banking fraud damage case.
